- Power of Attorney (Signed by the Applicant, no notarization and/or legalization are required. A copy is acceptable at filing date but the original must be submitted within 01 month from the filing date for non-PCT cases, and within 34 months from the earliest priority date for PCT cases);
- Specification, claims, drawings and abstract in English;
- For filing under the Paris Convention route: A certified copy of the priority application and the English translation thereof which can be submitted within 01 month from the filing date;
- For filing under the PCT route: PCT publication, International Preliminary Examination Report (PCT/IPER/409) (if any), Notification of the Recording of a Change (PCT/IB/306) (if any), International Search Report (PCT/ISA/210), etc.;
Required information
- Name, address and nationality of the Inventor(s);
- Name, address and nationality of the Applicant;
- Title of the Invention/Utility Solution;
- Priority data for claiming priority right under the Paris Convention (if any), including application number, priority date, and country;
- Strassbourg International Patent Classification;
- International filing number and filing date (in case of PCT applications entering the national phase in Vietnam).
Remarks
- Term for PCT applications to enter the Vietnam National Phase is 31 months from the earliest priority date;
- Term for filing a patent application under the Paris Convention route is 12 months from the earlist priority date;
- The Vietnamese version of the specification must be available right at the filing time;
- Request for substantive examination must be filed within 42 months (as to applications to obtain Invention Patent) or 36 months (as to applications to obtain Utility Solution Patent) from the earliest priority date;
- The validity term of an Invention Patent is 20 years and of a Utility Solution Patent is 10 years from the regular filing date and the Patent is effective from the granting date.

Required information
- Patent Data including Patent Number, Patent Owner (full name and address), regular filing date, granting date, priority date;
- The number of independent claims of the Patent;
- The effective year for which the annuity should be paid.
Remarks
– The validity term of an Invention Patent is 20 years and of a Utility Solution Patent is 10 years from the regular filing date. The 1st annuity fee is payable together with granting fees to obtain the Patent.
– Annuity fees can be paid in the duration of six months before the due date. Late paying the said fees is accepted provided that it is not later than 6 months from the due date and the surcharge of 10% per late month is required.

- 02 originals or certified copies of Assignment Agreement signed by both the Assignor and Assignee, if the Agreement includes multiple pages, both the Assignor and Assignee must sign on each page thereof;

- Notarized Declaration on Change of Name and/or Address by the Owner, or certified copy of Official Record on change of Name and/or Address; and
- Original Patent for Invention/Utility Solution.
Time frame
It would take about 4 months from the filing date to complete the procedure.

- Power of Attorney (signed by the Licencor or Licensee; no notarization is required);
- 02 originals or certified copies of the License Agreement, signed by both the Licencor and Licensee, if the Agreement includes multiple pages, both the Licencor and Licensee must sign on each page thereof;
- A certified copy of the Patent of Invention/Utility Solution. If the Agreement to be approved is a sub-agreement, it must be accompanied by a copy of the Certificate of Registration of the corresponding exclusive Agreement.
